Sales, SBU ASP, Construction, Construction NSEA
The Construction Department is in charge of all wind farm projects from Tendering to Project Completion. Prior to any contract award and in the Tender phase the team assist Sales & Legal & Procurement with putting together a construction schedule and plan to ensure each wind farm being tendered delivers the highest energy yield within the client's & Vestas specification and can be delivered within the timeframe proposed
The team takes responsibility for a wind farm once a contract has been signed and remains responsible until the final tests are completed and the Windfarm is handed over to the client and the Service Contract. Working closely with the logistics, procurement and finance departments, the team has to keep the project on budget and on schedule and ensures our rigorous safety and quality standards are met.
Responsibilities
Contracts Drafting, Evaluation, Negotiation, Execution and Management
Work with Project Management and Risk Management / Finance to coordinate contractual requirements
Oversee quantity calculations, technical documentation, as well as quotation evaluations for subcontractor's tenders when affecting to Contractual Conditions for both client and subcontractors.
Responsible for Non-Disclosure Agreements, Sales / Purchasing Agreements, Sub-contracts, Consulting Agreements, Licensing Agreements, Master Agreements, and review of customer proposed terms and conditions in consultation with Legal department
As needed, provide guidance on contract matters to project managers or other operational staff, including coaching to project managers and other employees in contracting practices and procedures
Analyze the Contract having particular regard for the contract procedures requiring formal notices, time limitations and other parameters to ensure that there is a complete understanding of the obligations and rights therein
Prepare submissions for Extensions of Time in alignment with the Project Director and manage subsequently negotiation process
Prepare Loss and Expense or Additional costs reports to which the Contractor may be entitled to from obstructions, disruptions, delays and other contractually allowable relevant events, and to coordinate the submission and negotiation.
Ensure appropriate risk mitigation and anticipation.
Fully analyze and follow up Liquidated Damages within the legality of the contract.
Prepare and coordinate with the legal department the determinations on interpretations under the Contract; preliminary action on dispute management, procedural compliance for potential contractual and legal consequences and potential terminations.
Maintain contractual records and documentation such as receipt and control of all contract correspondence, contractual changes & claim correspondence
Qualifications
Bachelor Degree or MBA
Minimum 7 years of experience in the field of complex contractual management
International experience involving cross countries and extensive experience in supporting large EPC Projects or complex renewable projects
Competencies
Effective communicator and an influencer in negotiation process, with ability to handle priority and tight timelines
Good stakeholder management experience across functions regionally and at global level
Excellent time management, and accuracy in reporting skill
Strong team player, motivated and ability to work with limited supervision and remotely when required
