Job Description

Reporting to the Project Claims Manager the applicant will be a senior member of a small high quality team of claims specialists responsible for preparing and giving advice in relation to claims and delays on behalf of a Consortium of major international contractors involved in the construction of two lines of the Riyadh Metro Project (RMP) in Saudi Arabia (CWJV or BACS). The candidate will be able to quickly review or prepare accurate evidence and facts, understand the relevant provisions of the contract and any applicable laws, and prepare or assess claims and potential claims arising from the Project. Establishes and enforces agreed claims policies and procedures in conjunction with contract and other applicable project procedures. May also be responsible for supervision and training of more junior claims or contracts personnel supporting claims and contract administration. May be asked to provide written, visual or verbal commercial or contractual support and advice to

ESSENTIAL JOB DUTIES
-High-quality fact finding, assessment, preparation and/or advice relating to Contractor or Sub-Contractor claims including:-
-Maintenance of accurate and up to date Project claims records and related information on Fileshare etc.:
-Application of Contract clauses and principles to the assessment and preparation of claims (merit, liability, cost and schedule etc.):
-Production of high quality, clear and concise written Contractor claims, assessments and related correspondence or advice;
-Provide claims identification, development and presentation support to the Project team, managing the resolution of claims as required;
-Working with Construction, Engineering, Project Controls and Procurement etc. to investigate possible claims as part of claim preparation;
-Possible liaison with Client representatives or other relevant third parties to review CWJV claims assessments and agree strategy for pursuing;
-Assist with preparation, submission and advice in relation to requests for Engineers Decisions under the terms of the Consortium contract;
-Provide support or advice for possible Mediations (LCIA), Arbitrations (ICC) or ICC DRB proceedings;
-Provide, if required, strategic commercial support and advice to Project Claims Manager, Project Commercial Manager or senior management on Project wide issues, assisting the business to assess and manage risk;
-Liaise, if required, with CWJV or Bechtel Legal Department with regard to Project issues including client / contractor mediations and arbitrations etc.;
-Assist, if required, with any local (Saudi) Project litigation proceedings including possible liaison with CWJC Saudi Legal Counsel;
-Establish and maintain proactive and professional interface with all members of the BACS Consortium, including Siemens, in order to maintain positive working relationships;
-Provide support, advice and training, as required, to the Project Contract Administrators or Prime Contract Administrators to identify, prepare, mitigate and manage CWJV Contractor claims;
-Ensure compliance with all applicable CWJV, BACS or Bechtel Project policies including quality, ethics, financial, commercial and contractual;
-Provide strategic advice or recommendations on both existing and new claims, policies and procedures;
-Assisting the Project and CWJV Project Management and staff to assess and manage risk;
-Educating and training relevant Project staff on claims issues and raising awareness levels across the Project as a whole.
-Provide as required claims reviews/audits to Project teams and staff to identify potential claims or claims problems and process improvement opportunities. Assist in the development and implementation of systems and resources necessary to make improvements;

High-quality, proactive, hands-on identification, preparation or assessment of Contractor claims and advice in accordance with the Job Dimensions and the Essential Job Duties outlined above.

Skill
-Written and oral communication skills plus contract analysis and interpretation
-Ability to develop working relationship across multiple construction disciplines and cultures
-Ability to understand Schedules, Schedule preparation including schedule analysis of construction delays
-Information gathering / investigation skills of facts and issues relating to claims and delays
-IT skills using Word, Excel and PowerPoint)
-Additional specific requirements as set out below

Other Qualifications Required:
-Minimum of five (5) years and preferably ten (10) years full time hands-on experience on behalf of a Contractor in the preparation of high-quality construction claims, preferably in a Civil Engineering and/or major Project environment;
-Construction Degree (or equivalent) from recognized University or Educational establishment, preferably in or with heavy element of commercial and contractual management such as Quantity Surveying or similar;
-Preferably a Fellow of the Royal Institution of Chartered Surveyors and/or the Chartered Institute of Arbitrators (or equivalent);
-Law Degree, Masters in Construction Law and Arbitration or Diploma/LLM in Arbitration (or equivalent);
-Extensive knowledge of commercial management, valuations, costs, pricing and demonstrated awareness of construction project commercial and risk issues.
-Experience in managing and supervising commercial and claims staff, preferably including on behalf of a Contractor;
